Purpose

The purpose of this policy is to outline how we use your data, how it's protected, how long it's stored for and more.

As a Motor Dealership, the main purpose of us obtaining your information is to try to supply you with a new or used vehicle of your choosing, and if applicable or you choose to, assist you in obtaining finance via one of our partners to purchase your vehicle, and explain about the products we offer which could support you in your vehicle ownership.

Motorplug Teesside Ltd uses the trading names of Motorplug. This Privacy Policy will cover all aspects of this business.

Why do we collect and use your personal data?

We collect and use your personal information in order for us to provide you with our services via numerous avenues - this can be in person on our premises, telephone, email or our website.

We act as a data controller.

Depending on how you use our services, we may process your information in line with the following lawful basis:

  • Contract - such as the contract we form when you purchase one of our vehicles. Of which we use your information is consent, we will not process your information without your explicit consent. Should you decide to purchase your vehicle by obtaining finance from one of our partners, you will form a contract with a lender. By providing you with a quote, the lender can also process your data under this lawful basis.
  • Consent - if we are taking a finance application or asking to contact you in the future with any information on our services or products, we will ask for your consent. We gain this information by you agreeing to our terms of business and privacy policy when you make an application, or by opting in to our communications. We kindly ask that if you do not want us, or do not consent to us using your information, you do not submit an application to us. You can exercise your right to withdraw your consent at any time using our contact details listed above. We will not use your data for any other purposes without informing you and gaining your consent.
  • Legitimate Interest - such as the use of our CCTV or if you are to make an enquiry or request any information regarding the services or products we offer, we will process your data on this basis. We may also remind you of ongoing vehicle maintenance such as MOT's etc.

The information we collect can be some or all of the following, depending on the product or service you are using:

We will never request sensitive information, or information that we do not require from yourself. However, if you provide us with data that is classed as a special category of data such as health information, criminal records of convictions and offences, or allegations of criminal offences, we will only process this with your permission (unless we feel the processing is necessary to protect your vital interests or if the law allows us to do so).

You have a right at any time to ask us to stop the processing of that specific data.

If you do not provide us with your data, we may not be able to provide you with our services.

What happens if I do not provide my personal information?

We need your personal information to process your request, enquiry or finance application. If we do not collect your personal information, we will not be able to provide our products or services to you.

We will use your personal information to send you marketing communications by email about similar products and services that you may be interested in.

Please note that we will not send you marketing information with your consent.

You have the right to object to receiving marketing communication and we will give you an easy way to unsubscribe from receiving any marketing communication from us.

Who will we share your personal information with?

Depending on the services and products we provide, your information may be shared with a variety of other firms we work closely with.

In order to assess your credit worthiness, the finance partners with whom we work with will carry out a search on your credit profile. We do not have access to any of the information they view, we are only provided a decision from them. For full details on how each of our finance partners may use your data, we kindly ask that you refer to their Privacy policy (links above) - however we are on hand to try to answer any additional questions you may have.

If you give us false or inaccurate information and we suspect or identify fraud we will record this and may also pass this information to FPAs and other organisations involved in crime and fraud prevention.

In order to assess your credit worthiness, the finance partners on our panel will use a Credit Reference Agency (CRA). You can contact CRA's on the below:

The personal information we have collected from you will be shared with fraud prevention agencies who will use it to prevent fraud and money-laundering and to verify your identity via our finance partners. If fraud is detected, you could be refused certain services, finance or employment. Further details of how your information will be used by our finance partners and these fraud prevention agencies, can be found in the above privacy links.

If required, we will also share your information with 3rd parties for accounting, legal or regulatory purposes such as (but not limited to HMRC, FCA etc.)

We may also use our CRM and communication providers to contact you regarding our, or to provide our services. These systems may store and process your data to allow us to provide these services. This includes, but is not limited to, live chat, email, telephone, SMS, whatsapp, post and social media. We are happy to provide additional information, this can be requested using our contact details listed in Section 1 of this policy.

In order to provide our services, we use a range of different communication services and software. We are happy to share these on request.

Please note we as a company do not share your data outside of any EEA state. We ask you to ensure you are aware of how the above companies share and use your date, so you are fully aware.

We complete due diligence on any third party with whom we work with to ensure they comply with GDPR and are happy to provide further information or answer any questions you may have.

CCTV

As a business, CCTV is used within our premises for the purpose of security and monitoring.

We will make you aware of the presence of CCTV via this policy, and signs within the business.

Our CCTV will record visual only, our CCTV does not record audio.

CCTV is only accessible to our Senior Management team and will be reviewed as and when is required.

This will not be shared with outside parties, unless we are required to do so by law.

CCTV footage will be kept no longer than 12 months and will be destroyed of confidentially once this date has passed. Where we are required to keep this longer for investigation or legal purposes, this will be held securely and destroyed as soon as we are able to.

How long will we store your personal information?

We will store your personal information for up to six years on our systems following the completion of your purchase, or your last communication with us. We are committed to ensuring your data is kept secure so review our security systems on a regular basis.

This is to enable us to refer to our records should we be required to for the purpose of regulatory or lawful reasons.

If you do not object to receiving marketing communications from us, we will store your personal information for marketing purposes until you unsubscribe from receiving marketing communications from us.

Please note that some of your information may be included in information used for accounting purposes. Where this is the case this information is kept for 7 years as per our legal requirements.

Once this time period has ended, your information will be confidentially destroyed and removed from all systems and records.

What are your rights to your personal information?

How do I lodge a complaint about the use of my personal information?

Finance is secured against the vehicle. Your vehicle may be at risk of possession if you fail to repay your loan.
